Sorry to jump on this post but I was just reading it
I am in the process of trying to buy my ex husband out of mortgage/ property
The Iva has told us he has equity in the house and they are having a meeting in a few weeks for the creditors to decide if he can be released from the property but if they agree is this just the property or both the mortgage and property?
Will he still have to sign and agree to come off the mortgage if they release him from the property?
It’s so confusing any help will be great?

The mortgage and the IVA are two separate things. His share of equity might be due to the IVA to be paid to creditors. They are looking at whether the creditors will agree to this not happening (for which they might extend the IVA instead). If they release the property it means an attempt to release equity will not need to be made.

Then -- separately, it will be up to the mortgage lender whether they are willing to take him off the mortgage, which he will have to agree to and sign over his interest to the property. The mortgage lender will have to be happy that you can service the mortgage alone.

Thank you it’s so confusing
I just want the house for me and my girls
Like I said I’ve been paying it for 4 years on my own
I have been to see a mortgage adviser and he said I can get a mortgage on my own so I’m just hoping the creditors agree and I can hopefully have the house and mortgage on my own
I was just worried if he has to agree to sign to come off the mortgage because he won’t
And I don’t want to paying a lot of money to the Iva and I still can’t have the house/mortgage in my own name
