It's a shame if you weren't advised that bankruptcy would not mean losing your home before you entered the IVA, or even when your circumstances changed and things became difficult. As others have said, you have made every effort to keep the IVA going, if it has to end you go bankrupt then you know y...

Hi Chris, it doesn't look to me like an IVA was the wrong solution for you, if you had opted for bankruptcy you would have almost certainly had to forfeit your car for a cheaper one, assuming you required a vehicle for getting to work you would have been allowed at a value of less than £2,000. You ...

The term case worker is a little bit suspect here I think, it gives you the impression you will have a dedicated person who will assist you through your iva, a buddy so to speak, which when starting the process and feeling vulnerable will no doubt sound quite comforting, when in reality all applican...

Hi, i think you will find it very difficult to get a mortgage while you have an IVA, apart from anything else affordability would be a problem, you would need a very large deposit to start with. Owning a property may also create unwanted complications in your IVA. Renting is a better option if you r...

Hi yanyan, sorry to read that things have become so difficult for you, having previously spent 25yrs as a self employed sole trader I can immediately relate you what you say. Is it a courier business, or taxis maybe? It is definitely worth exploring the option of an IVA, it may well be the best opot...

Hi John, Lesley is correct in that if you have acknowledged the fact that you are insolvent you should cease to use credit. However, it's possible that you have only been surviving by using the overdraft facility, in which case you may need to use some of that money to get you through to payday with...

Hi Kim.3, If it's a car you have previously hired and no longer have the use of it but there is an outstanding bill, then yes you could include that debt in an IVA. It would be treated in the same way as all your other unsecured debts. Like the others say, best to speak with someone to establish you...

Hi Mrs R, what bad timing for you, just when you are on the final approach. In a way it is better that this happened now rather than in 1months time, although even then I'm sure every effort would be made to assist you. I would expect that you IP will be able to make the adjustments required but it ...

In most cases where relatives take loans for family members there will be evidence of a bank tansfer between the 2 accounts, how else would the money be exchanged, cash I suppose, unlikely though. If the debt to mum can be documented then she will have to be included in the IVA as a creditor, them's...

Hi Hazel, Unfortunately your mum wouldn't receive a dividend in your IVA as she would be an associate creditor, she would be entitled to vote on your proposal but would almost certainly be expected to defer her interest until the IVA was complete, so this would be no help to you at all, she can't af...

Not sure just what I've done to rock the boat here, perhaps someone can explain. The OP contacted me to ask for advice because she had been trying for 3mths to obtain a particular response from Melanie and her team, as she stated she is 2weeks away from losing a buyer for her house, which, if comple...

Glad to have been able to help you with this Anne-Marie, once you had explained your dilemma to me when you called I was convinced that a post on here would get results, although what a shame you had to go to such lengths to make anything happen. I note that you joined the forum to find some guidanc...
