So Varden Nuttall court case was heard yesterday before HHJ Pelling in The Chancery division at Manchester high court. And was hoping to get the decision so my completion certificate could be issued finally after months of back and fourth. I contact FRP late yesterday to be fob off with we don't know what's happened yet etc. But to be honest they haven't been much help in the whole sorry situation. And I did try and look on the Internet to see if a decision or ruling had been pasted but struggling anyone else know where we I could look for yesterday's ruling please.

Hi,

As far as I aware, there is only one court case going on which is Green V Wright and is going to appeal later in the year. Until then you can get a completion letter as long as you sign a deed of assignment for future PPI claim.

I was not aware of any other court case.

If you havent already done so - try using the link in their website - to enquire on Completetion certificates

It seems a bit soon - regardless what that ruling is - for it to be published - the website(as above ) have indicated that when the ruling is known then they will contact people

My understanding was the new hearing was set for November.

In any event as your IVA is still open it probably won't make a difference to you - if you want your cc early you should be able to assign your PPI interest to them - either way they won't close your case until the PPI has been dealt with, by assignment or by confirming whether any PPI refund is avail;able and if so, receiving it.

Hi All, so I got an email today from FRP and from my understanding is now a matter of time till we get our completion certificate, below is a copy of the email

Good Morning,

On 8 July 2016, the High Court considered an Application made by the joint New Supervisors of the IVAs of Varden Nuttall Limited – In Administration (“the Company”). The New Supervisors sought permission from the court to allow completion certificates to be issued to those customers who had complied with their obligations under their IVAs, notwithstanding the fact that creditors of those IVAs cannot be paid until the Company's accounts have been reconciled.

The court had to give a great deal of consideration to a technical legal point which meant that allowing completion certificates to be issued was not as straight forward as originally envisaged. However, the court was mindful of the need to allow those certificates to be issued and to allow customers of the Company to be able to get on with their lives.

In order to deal with the legal technicalities in a practical way, the court has proposed a solution whereby undertakings are given by the New Supervisors. These are in the process of being done. However, the court will still need to give final sign off before action can be taken. We are working with the court to ensure this is done at the earliest opportunity and we thank everyone for their patience throughout this process.

I would suggest that any previous IP's linked to that company are likely to be fined or never work in the industry again.
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.
