I am 4 and half years into an IVA and have been asked to provide a valuation of my ex marital house, redemption statement and mortgage offers. But I can't do any of these as my ex will not give me access to the house and therefore I can't get an estate agent to value it for me. I moved out 4 years ago into rented accommodation and do not contribute to the mortgage as with rent and my iva I couldn't afford it. My ex pays the mortgage but was unsuccessful at getting it changed soley into his name. What should I do to try and rectify this? I can't afford to take him to court to force him to sell and despite solicitors letters he refuses to put it on the market. The house is about 50k in negative equity which is why I think he doesn't want to sell. Also the mortgage provider, Santander will not entertain a remortgage. Also he is not living in the house either, it is currently vacant. Would be grateful for any advice that anyone can offer who has been in a similar position. Thank you.
You need to speak to your IP company and explain this to them - you can always get an internet valuation to give to your IP.

As one of the mortgagees you are entitles to get a redemption statement direct from the lender. You can get online valuations and, if they confirm massive negative equity, the property will be taken out of the equation anyway.
My opinions are merely that .. opinions based on experience. Always seek professional advice.

Thanks for replies. Is it possible to get online valuations in N.Ireland?
It's so close to the end of my IVA I want to make sure I do all I can for it to end at 5 years.
No idea on that one I'm afraid - hopefully one of our more knowledgeable experts can help.

I would tell your ex that if a valuation isn't obtained your IVA could fail, you could be made bankrupt and the house could therefore then be reposessed and sold by the Trustee in Bankruptcy so in their interests to be a little cooperative.
I also would have thought they would be interested to know how much the property is worth too.
You can always consider a drive by valuation which would be the next best thing.

Thanks Lisa. My ex delights in being as uncooperative as possible. I had to do all the chasing throughout the divorce and now having to take him to court to actually get the house on the market as he is refusing.
So that could be good leverage. Thank you.
You're welcome - best of luck. If the property is going to be marketed and sold all of your share of equity will likely have to be paid into IVA anyway so could be academic...
