Hi all, I don't know if anyone remembers my post saying that my iva is 1500 pound short after 7yrs and I'm not in a position to pay? Dfd said my only option is bankrupcy! I contacted judith and practitioner as advised but never got any replies! So still worried sick:(

Do let us know the outcome of this Nichola. No-one should have to face bankruptcy at the end of an IVA for such a small sum. Even if the terms of the IVA say this is the only remedy, they are easily varied by calling a creditors' meeting.

Hi Mel, I have emailed dfd all afternoon and they have said due to final settlement of 1500 now not an option my IVA has too fail and one of there advisors will be in touch to tell me what happens next. Awful situation. Totaly devastated and can't believe we got this far. Dfd are not prepared to go back to creditors. Xx

DFD's stance here beggars belief! They are not even prepared to seek creditor approval!?

I daren't comment further!
My opinions are merely that .. opinions based on experience. Always seek professional advice.
IVA Completed 23rd July 2013 .... C.C. 10th January 2014

I think if they made you go bankrupt the official receiver and judge might have something to say on the matter.
cc received 6th January 2014 now upwards and onwards

I really don't know what the out come is going to be, I was told that someone else would contact me to tell me next stage of process? She said that dfd will take their fees and costs (10k) and the rest will be shared btw creditors so doesn't make sense to me! They know I cannot find any extra money and they get their fees in full so what do they care?xx

Find out what they are relying on when making these threats to you, and I will see if I can intervene for you. I am conscious that there are usually two sides to a story, but I am struggling to understand their position on this one.

Really feel for you ... i hope with Mel's support you can get this resolved. It is the last thing that you need right now and in my opinion seems very very harsh .... Try and stay positive x
