Hi Hope you can help!! I have recently entered into an iva, however my partner has a car finance agreement and they have now sent a notice to her saying that they will be taking the car from her as she has broken the terms and conditions. The iva company have said that they have written to the car finance company saying that they have no interest in the car, etc my partner has never missed a payment in the 18 months that she has had the car, and still has a further 2 years to go, they are being really horrible about this and she has to travel long distance to work and is upset as she will not be able to get to work if they take the car!! any advice would be appreciated. They are more than likely well within their rights to do this. I think you should speak to your IVA company and ask them to cal them to explain that the monthly repayment has been included within the expenditure. They could also send them a copy of the Income & Expenditure.

Hi Hi Are you both in IVAs ? This is quite common, however if you talk to the finance company and insist that an allowance has been built into your IVA to make payments they will usually allow you to carry on paying. Regards
