Hi,

I had an IVA in 2008 which defaulted. Since then I have heard nothing from the IVA company and very little from the creditors involved. Now that 6 years has passed I have been checking Equifax and Experian and have noticed that all the creditors have dropped of my credit file for both Experian and Equifax.

I can also see on Equifax that the IVA public record has gone but this isn't the case for Experian. They say they need a certificate of completion or termination to remove it. I don't have either.

What can I do next?

Your old IP firm may have a certificate of termination so probably best to start there. If they do not have it I would assume it should fall off at some stage but only Experian could answer that.

You need to clarify exactly what has happened here. If the IVA has defaulted then you still owe the companies the money. I dont know if there are any limits on the time they can come back to you, but I suspect it will be a long time

I would have thought you need to talk to the company you took the IVA out with. Did you get paperwork for the default?

Did you not receive a copy of your IP's closure report, which should have included all of the information you require? If not, or if it has been mislaid, you can always get a copy from the Court in which your IVA was administered.
