Hello!

I need some advice, im on IVA 2,5 years now. I ask for two breaks because my husband was on hospital and we didnt have money to pay. In July my husband was working less hours so i ask to move my payment from end of July to 07.08. I receive email that they sendind me notice of breache and its possible that i will need to pay my full arrears now. What can i do? I ask them to send me stament with all my payments but i receive answer that they dont do that. Any help please?

Hi. Who are you with ?

What you have described is not cause for a breach, unless they are treating your request to move the payment as a missed month, as you will be making the payment in August and not July.

Will you be making the August payment at the end of August as normal ? In which case the breach would have been corrected.

Hello!

Im emailing with someone and: when i ask for a break, i didnt get it, so i have two missed months. :(

Yes i will pay August payment on end of August notmally.

If you miss three without permission they could fail the IVA.

Yes, i know that but i was convince that i had a break not miss payments.

A notice of breach is not the end and you can negotiate a remedy with your IP. I would ask to speak to your IP directly and ask him or her (not the case worker)if the break you thought you had agreed could now be agreed and the missed payments added on to the end.

It may be necessary for the IP to issue the notice but it can be rectified. You should be fine.

Hoping when you called your IP it was sorted for you?
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.
