I CURRENTLY HAVE A MORTGAGE WITH MY HUSBAND, BUT WE ARE SEPERATING. HE WANTS TO MOVE OUT. WILL I BE ABLE TO TRANSFER THE MORTGAGE INTO MY NAME? I AM IN MY LAST YEAR OF MY IVA (although now extended - will finish dec 15). WE ARE ALOS ON A VARIABLE RATE AND OUR LENDERS WILL NOT PUT US ON A FIXED RATE? WHY IS THAT?

It is unlikely that the mortgage company will agree to this but if they do you will need to inform your IP and let them know what you are doing.

Many lenders will not offer new or good deals to those in IVAs as they know the clients cannot switch lenders. This is unfair but little anyone can do about it.

I called Chelsea about this recently and they said that as long as all payments are up to date, they wont stop people switching on to a new rate.... for those who are with Chelsea BS... :)
