I'm in an IVA my husband isn't, we receive child tax credits. I know they are classed as income but should they be split 50/50 when working out my I&E as it is a joint claim?

We usually allocate the tax credits to whoever's name is on the form. Sometimes it is one name and other times it is both. The fact that you are in an IVA and your husband is not is relevant as it affects your payments so a 50/50 split seems a reasonable compromise.

Thank you Michael, that's what I thought. Both our names are on the claim but step change class it as my income only

Hopefully Stepchange agree to this but if not you and your husband should seriously object to your IP as he cannot be made to contribute to your IVA.
