Just for info, I have had sleepless nights for a long time about being asked to be the DPS of my workplace (I knew it was coming) whilst being in an IVA but have just been appointed with no issues at all[:)]

There is no problem being DPS but you cannot hold a premise licence. .

yes I do, weirdly I was on the premises licence( jointly) until this year, but was on that pre Iva

The premise licence automatically lapses on the insolvency of the licence holder and must be transferred. Failure to do so can lead to substantial fines so lucky you are no longer on that licence. You can hold a personal licence and be a DPS but for some reason the premise licence is a no-no.

Section 27 [1]of the licencing act covers it and I believe fines of up to £20,000 can be levied. It rarely crops up but we always check with our clients whether they run pubs, restaurants, corner shops or supermarkets. The licence is easily transferred but it needs done.
