I have PPI to come back from a ceditor who is not in my IVA and whose debt was repaid prior to my iva. am I entitled to those funds as they are not part of the agreement.
Technically they are part of the agreement as an asset, regardless of source. However, some IP's disregard PPI from creditors outside of the IVA. Only your own IP will be able to say which way they will jump.
The source of the asset is immaterial --- if you owned a Da Vinci you would be required to realise this asset for the benefit of creditors even though you inherited or purchased it decades ago.
My opinions are merely that .. opinions based on experience. Always seek professional advice.
