Will I lose pension to IVA as GT have not yet sent completion certificate ?

Hi,

2 issues:
1. I finished making all the payments successfully on my IVA in November last year 2013. I have not yet received my completion certificate from Grant Thornton. They have had all the documentation and ppi refunds sent to them as I have been claiming it back myself. I wrote asking them to let me sign a form to say that I believe there to be no further ppi to claim and that I was not missold anything else. They have not replied.

2.Grant Thornton are taking a long time to get back to me. I am in the process of divorce from my husband from whom I have been separated for many years. However, whilst all marital assets were split at the time of our separation in 1997, it appears that I may be due a share of my husbands pension fund. What I would like to do is put this straight into a pension fund of my own as I am 60 years old next year, but would the IVA want me to use this for the IVA as I don't yet have my completion cert?

Hi Jane,

I would suggest you contact GT to find out what the hold up is. Whilst doing so ask for details of their formal complaints procedure. If you then get no joy, escalate a complaint to their regulators.

There is a possibility that they will try to get any monies paid to you paid into the IVA, so the sooner you get that certificate the better.

Would this be the case do you think even if the money went directly from his pension fund into a pension fund in my name.

I cannot answer definitively, but, as it will be basically a transfer from fund to fund, with you getting no cash in hand it would probably be OK.

Pension funds are often excluded from IVA's, which might be the case here.

Thanks Foggy. I emailed Gareth Neill this afternoon, complaining at the length of time things were taking for the completion Cert. I had a phone call from the closure team half an hour ago. They promise to get back to me in a couple of days with an update. They say they are working on it now. We'll see...

Amazing, I received a call today from the closure team, telling me that they we're emailing me my completion certificate and I would also get this in the post. Suddenly it's all finished! whoopee! I'm over the moon that it's finally finished.

Congrats and have a great Christmas debt free.
Last Payment made 04/12/14. Completion Certificate 25/7/15. IVA company GT. No Issues
