Entered into an IVA in July last year and this included a tax credits overpayment. HMRC contacted me in December to say they would be recovering an overpayment from my award at £48 a week (the same overpayment included in IVA) when I contacted them they said there was no record of my IVA on the system although the IVA department at HMRC did have a record as they have me a reference number for this. I have written a letter explaining the situation but at the moment they are still taking the £48 which I cannot afford. Is there anything else I can do and is there a chanc they will pay me back the money they have taken once they recieve the confirmation of my IVA. TIA

Speak with your IP who should be able to reduce your payments while this is sorted out. The tax credits will be a debt in the IVA provided the final award notice was issued before the meeting of creditors.
