Hi I hope you can advise me.I went into an iva following a debt management plan after receiving an hmrc overpayment of 7,000 after losing the tax credits to my ex in court. I was advised by the dmp to go into an iva which they offered to set up. 8 months into the iva my brother offered to do a settlement which was accepted. Now hmrc are saying the debt is not included in the iva because we did not wait for the final letter. I lost the tax credits to my ex in the december and the iva was approved on april 26th after the tax year ended. My iva practitioner has told me to seek legal advice but I cant afford a solicitor. In the meantime the money is being taken from my tax credits which I was awarded again.

go to your local CAB.

seriously, get down there as soon as you can, most of them either have a duty solicitor (most of them specialise in criminal work (due to how CAB's work, 99% of the cases are crime cases))

The CAB / solicitor may not be able to help directly, but they will be able to point you in the right direction as far as help is concerned..

the key question to ask is if they can look at your request pro-bono (free of charge) as that really what you want.

Unfortunately HMRC are probably right. The IVA should not have been proposed until the final award notice was issued otherwise it is a post IVA debt. This is common knowledge so ask your IP why the IVA was put in place early.
