i just recently claimed back PPI. need the money or I'll be bankrupt again

i just recently claimed back ppi i was due years ago.
i am getting a few thousand from the bank but i went bankrupt a year ago .
i am still in a lot of date and need the money to pay on bills or ill be bankrupt again

Hi - are you still bankrupt? If so the PPI money will be due to your Bankruptcy estate. If you have gone Bankrupt all of your debt (except certain exclusions) will have been wiped out with your Bankruptcy so I don't quite understand how you could have incurred more debt since going bankrupt. Is it definitely Bankruptcy you have entered into?

Hi

I am sure that it will be seen as an asset at the time of your bankruptcy and may have to be paid to the trustee of your bankruptcy

When were you discharged from bankruptcy ?

I echo Lisa's comments and concerns. Whether discharged or not, this will be an asset to be paid to your Trustee.

It IS an asset of the estate regardless, and does need to be paid over. Not to do so is an offence. Further, it is always an asset of the estate and you could not, for example, just delay the claim for a while and try again a while later.

That said, I have seen discharged bankrupts be paid the money and keep it, without declaring it to the Trustee, and get away with it, but that seems a very risky strategy from where I'm sat.
