I'm a year ad a half in to my iva plan and it's not good I've had me first review and I've been told I've earnt to much so I did my I,e form the first one they didn't get and now there still waitting despite the fact I've sent it in with all of me bank statements for the second time. I'm at a loss now I don't know what to do my payments are set to go up due to excessive pay till I pay back what is owed
Your review should be done within two months of the anniversary. Overtime, bonuses and commission payments are to be paid over within 14 days of you receiving the money so I am not sure what your IP is requesting. If they are seeking an uplift going forward this should only be for half of any extra surplus but if it was overtime etc then it is possible you are in breach and this requires a variation or the payments brought up to date. You need to speak with your own IP.
Speak to you IP to try and sort out the detail here. I suggest you keep a copy of everything you send in future and send it recorded delivery as belt and braces job.
If you have earned overtime or bonus payments, but not paid this over as your earned it this will need to be made up. But, I would suggest you have a good read of your paperwork, as these provisions are included and you need to know what your obligations are if the IVA is not to flounder.
