My wife has had no success in applying for redundancy pay as employer has applied for IVA.

My wife has been made redundant from her job and has since found that her formal employer has applied for an IVA rather than going insolvent. Is this legal? My wife has had no success applying for redundancy from the government as they do not have an insolvent number because of this. Please can anyone help?

Once her former employer's IVA is in place the redundancy payments scheme will cover her. She will currently be a creditor of her former employer but the government steps in and pays her off. This will not happen until he is formerly insolvent but his IP should be able to advise you better.

Hi Darren Michael is right - Your wife is currently a creditor and should receive details of the IVA from the IP firm handling it. Once it goes through her former employee is formally insolvent and the RPO can then take steps to process her claim.
