Can I obtain an IVA without my husbands knowledge ?

Can I obtain an IVA without my husbands knowledge. We are financially seperate and he is not responsable or aware of my debts.

We have a joint names property only, would there be a claim against it

He would end up finding out about it because of the claim on the property.

Also, dependent on who you go with they may want to take his income into account.

You would also find yourself financially restricted for at least 5-6 years.
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.

He would have to sign the restriction on the house, but you would also have to get to the post first every day, as well as answer the telephone first every time it rings --- a lot of strain on you and on the relationship.

Your husband should be advised to seek independent legal advice so he should be informed. It would be best to tell him anyway as I am sure he would be hurt if he found out elsewhere.

Hi and welcome

If you co own a property then yes they will be informed because of the restriction notice lodged at land registry

You could however run a Debt Management Plan with no one else knowing
