Good Evening all, I'm hoping someone can help please! I have 17 months left on my IVA with DFD and going through a very drawn out divorce with EX who is part of the IVA too. We had come to an agreement to make a full and final offer of the outstanding amount so divorce could get sorted earlier but Ex has decided he can't come up with his share of the money and is expecting my parents to pay it all. The IVA is so-called Joint but I know it is really two arrangements linked, so can I offer DFD half of the outstanding amount to clear my liability to it? DFD customer service seems to be diabolical at the moment, 50 mins on hold last week to speak to someone and then they get confused on facts and everyone you speak to seems to tell you something different!! They also seem to take forever to do anything. They wrote asking me for my annual I&E review but never bothered to ask ex, we only did one December last year anyway, i'm at my wits end with them! Any help appreciated, i'm desperate to sort things out and get debt and divorce sorted so I can move on! Thank you.

Email Evette Everest at DFD, explain the situation and request that the IVA's be unlinked and you be allowed to deal with your own IVA in your own way.

Hi, Thanks for the reply, is this even a possibility? I don't want to be fobbed off by DFD when I speak to them, thank you.

It can be, and has been, done, but requires a bit of work by the IP, so they don't like doing it if they don't have to. In some cases, depending upon the wording in your agreement, it might need a meeting of the creditors for their agreement.

It probably would need meetings to be called to sever the arrangements but this is not uncommon. If your ex is not playing ball creditors may well have sympathy for you and allow yours to close. He would then have to deal with his creditors and the joint ones himself.

Hi, quick update, Dfd rang me and I spoke to them, they said it can be done and I have started the process to do that. Ex has been advised and asked what he wants to do so I guess it's just a waiting game now! Fingers crossed all can go ahead as I can't take much more of it. Thanks for your help.

That's good news - hopefully all be sorted soon.

Might force his hand and make him come up with his share. Best of luck and good to see DFD behind you.

It is good that DFD are assisting (some firms can be a little reluctant). Best of luck going forward.
