The wording is critical - there was one case on the board recently where someone found out that because they could not remortgage the wording meant that they had to sell to realise equity.
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.
We do not ask our clients to sell their investment properties in year five or six. It may be something that is done at the beginning of the IVA but if the profits from the buy to lets are funding the IVA then it seems unfair to then ask the debtors to sell on top of this. One of the reasons for entering an IVA is to try and protect their portfolio so we look for the properties to be remortgaged to 75% loan to value or the IVAs extended.
