My estranged husband is about to go into IVA, he had a very large amount of maintenance payments in arrears and an ongoing monthly stipend maintenance payments to make, will he be exempt from these payments when he invokes IVA or how will my situation be effected, will my income be effected, we have not lived together for 3 years now and due to my ongoing court battlesI have not had the time or money to file for divorce/ separation, I am at my wits end with worry, can anyone offer advice, thanks

If the maintenance arrears are via court or the csa he is still liable for them.

Make sure you have no joint accounts etc. as you could find yourself liable.
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.

Make sure the IVA makes allowance for continued payment of the maintenance and a monthly contribution towards the arrears. As Lifenoteasy says you are not bound by the IVA and are not obliged to accept a percentage in the pound.

Child Maintenance arrears survive IVA so he needs to keep paying these and as such these payments need to be included in his allowable expenditure. You might want to ensure the IP is aware of this.
