I am 1/2 way through year 4 of my iva and for the 3rd time I am being asked to sign forms to look into ppi. My question is who pays for this to be repeatedly investigated ? does it come out of iva funds in which case should I receive a windfall or successfully remortgage will I then have to pay this as a fee ?
This happened to me with EIF, they sent five lots of forms for the same creditors so I put complaint in which fell on deaf ears. At my yearly review I received breakdown of expenditure etc and they were only paid a set fee.
The whole thing is perverse really - repeated investigations means that it is your creditors also having to bear the brunt of this and generating bad feeling.
Also there is now a deadline for 2018 for all claims to be submitted so pressure on the claims companies to make money while they still can.
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.
This is the same claim - I have 4 creditors and I have signed twice already for ppi to be investigated on these 4 debts. - I chased this up with iva company and ppi claims company and was assured there was no ppi owing . However this is another ppi company instructed by same iva So it is making me very uncomfortable signing again - wherever the money comes from or whoever pays for this investigation myself or creditors out of iva funds it feels like someone is making money for investigating the same thing or do they investigate for free ? Can I refuse to sign ? Reading through these it appears if you don't sign it delays the closure of iva or you appear to be not complying with terms of iva -which is simply not true
I think you can at least write back and say you have already signed 3 times previously and ask what your IP hopes to achieve by looking a forth time and in any event why s/he needs further consent from you.
Thaink you for your responses very much appreciated - I actually had a call from new ppi investigation team this evening - advised me that they had been instructed by my iva company to investigate the previous investigations into ppi as way of an audit as it had been found some creditors had not been subject to a thorough enough investigation however they needed my signature . I asked who was paying for this 3 rd investigation - they didn't know said it depends on terms of my iva but said I might be able to keep some of the money which I am not interested in - I simply want to pay my debts off not increase them . So I am going to check t and c of iva and if I don't have to I will not be signing . Also who gave her my details - I haven't agreed to that either is there any data protection ? I wouldn't mind at all if I had signed first but I didn't and I happen to be involved in designing some data protection in my job and I m not sure this sharing of sensitive information is allowed - I can find out though or can anyone advise me on that ? I was quite happy with iva not so much now

Unfortunately too many assumptions are being made by IVA companies with an over-reliance on implied consent.

You might want to complaint to your IP that you did not give permission for your personal details to be handed to the 'ppi investigation team'. I would take this further. 4 investigations is overkill.
