My husband took out IVA after starting divorce proceedings but before FDR or final hearing. Please could you advise if I am bound by the IVA. Also could prove he failed to declare assets on his proposal - thus breaching his IVA conditions, do you think this is a worthwhile avenue to persue?

Hi and welcome,

If the debts are just his then you won't be bound by them but if he has not declared anything then you can speak to his IP to see if this makes any difference.

Be aware, however, that if you jointly own your home, jeopadising his IVA could result in his creditors considering bankruptcy and the house would then be in peril.

That said, if his failed disclosures are significant and the IP finds out, it could be failed anyway.
