Hi everyone.

I completed my IVA in January after a F&F offer. My IVA provider refused to send my CC due to the ongoing Green vs Wright case.

Today I received a letter saying if I want my CC then I need to sign an agreement to agree that any future PPI claims are payed to my Creditors. Is this the norm?

Should I sign it to get hold of my CC therefore getting closure of my IVA. Or shall I wait it out and see the outcome of the upcoming Green vs Wright case?

Is there possibility if I don't sign the agreement and the upcoming case returns in favour of the debtor, my IVA provider may not send me my CC at all?

I'm confused, any advice great fully received.

Regards

Colin

Hi,

At the moment this is the norm - if you sign it you will get your completion letter quite quickly.

Hi Colin. It is best to sign it, after making sure you are clear of the contents. If you do not sign and the case goes in favour of the debtor the IP will withold the certificate until such time as he is happy PPI has been dealt with, which could be a while.

Also check the wording of your F&F. Rarely, these days are they actually either Full or Final, depending on the wording. If creditors have a agreed to the variation using the terms "Full and Final" they have signed away the right to any future PPI.

Had the same letter. Signed it and got my cc 3 weeks later. i couldn't care less about future ppi. Completing is the most important thing after all the years of been in debt and the 5 years of the iva. PPi was just not on my radar.

I had £8K PPI, had over £31k written off and saved around £15k in interest I didn't have to pay ... so, in my book, they are welcome to the PPI and whatever else is found, as I am quids in !!

I would say, though they might argue differently, that if they have agreed and used the words "Full and Final" the future PPI should be yours.

I have always said, once the IVA is done and dusted, I want to draw a line under the whole sorry saga, so I won't be re-visiting PPI.

Same here - I only ever had £50 PPI paid in which I knew nothing about which appeared in my Paypal plus account but nothing else.

I won't be trying to claim either.

As you say Foggy - it's saved us a fortune in interest and charges.

Hi

I agree with above, just sign it so that your IVA can complete, you will usually never benefit from any PPI claim so you have nothing to lose and much to gain

Hoping that certificate is received soon without delay. All the best.
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Either way they are going to keep the PPI - because you have assigned it or because they won't issue your CC until they have recovered it so would suggest you sign it and send it back.
