Temporary overtime

I got 400 last month in overtime which I have to put down for official receiver to work out my disposable income but this is not gauranteed so seems unfair it's because we are short staffed what happens when they get back to full capacity I won't get any overtime

Hi and welcome,

Are you in an IVA or bankrupt? Check your paperwork as to whether or not you are subject to the 10% 50/50 rule.

Either way, as soon as the overtime ceases then you will go back to your original payment.

Some IP's do, for various reasons (not all valid) include "regular" overtime in the basic calculations, which, unless there is a valid reason, is wrong and is a recipe for disaster.
My opinions are merely that .. opinions based on experience. Always seek professional advice.

You have mentioned the OR - Are you Bankrupt? Just explain to the OR that the £400 was a one off overtime payment and provide other wage slips to show what the normal amount it.

If you can't afford it an Income Payment Agreement/Order will not be made.
