My ex husband and I split. Is it legal for him to have an IVA without me signing anything ?

my ex husband and i split nearly two years ago, i left the marital home as he wouldn't leave, we have a joint mortgage on the property, i found out a few months ago that he has taken out an iva against the property, i haven't seen any paperwork or signed anything is this legal.I am now looking into a divorce

Hi and welcome,

He does not have to tell you about the IVA but you are still bound by the mortgage.

He hasn't lodged any interest in the property, although there will be a restriction placed on the deeds so that it cannot be sold without the IP being informed.
My opinions are merely that .. opinions based on experience. Always seek professional advice.

Hi IVA is to cover his unsecured liabilities.

I presume the IP did not register a restriction against the property as I believe you would have had notice/had to sign it.

Any financial liability order granted to you in the divorce will be a post IVA debt that he will still be responsible for.

How the property gets dealt with in the divorce proceedings might affect his IVA but that will not be your problem.
