This might go on a bit so apologies in advance. SHL asked us to sign forms to take Barckaycard to the Ombudsman as they had not received any requested information regarding PPI. We have today received a letter from Barclycard with copies of a letter that should have been sent to us in April last year which stated they had reviewed the claim and would now be paying a refund of £7084, which was also not received. We actually received our CC on 4th May this year, does this mean this cheque will belong to us, we have not signed, as far as I'm aware, a deed of assignment but as this money should have been received in April last year will we have to hand it over. Barclycard have asked us for a copy of our CC if we have received it so they can send the funds to us. Is this all to good to be true.

Yes, it is too good to be true, I am afraid. As it stands the PPI is still an asset of the IVA, pending the outcome of the appeal case which was due to be heard a few weeks ago, but was postponed to the end of the year.

Of course, the question is what, if anything, will your IP do about it if you did hang on to the money ? To be honest I, personally, wouldn't like to be a test case.

That's what I thought Foggy, think I will ring and clarify. On the bright side we should get the statutory interest back at least.

I think you will have to wait the outcome of the Appeal now due to be heard in November.

However if the form you signed was an assignment document then the refund will vest in your IVA estate in any event.

Mystery solved, apparently this was paid into the IVA last April but they are trying to claim it again.
