This is my second post on this forum after all the great advice I received the first time around I thought I would return to try to get an answer for my latest question! So my Full and ?final offer was accepted and paid last week! I thought I would check my credit file and start to make a plan to repair my credit history once my IVA is officially completed.

I notice 2 open account with the Halifax, one for an overdraft and one for a credit card. Both show monthly defaults throughout the duration of my IVA and as recent as last month. Is this correct? It shows the date of default just before my IVA started but then shows monthly continous defaults.

I also have a CCJ showing as active, the CCJ is related a to a commercial debt (but it was in my name as a sole trader) the debt was included in my IVA but they never proved the debt so it shows as £0.

What is the situation with the CCJ? I understand even though they haven't proved any debt so haven't received anything they are still bound by the terms of my IVA. But should the CCJ still be showing as active? If not then how can i remove it?

Hi Jax,

They have to remove the defaults back to the start of the IVA although the IVA will still show on your record for the full six years.

If the CCJ was included then I would think that it should be removed as well. Speak to your IP and see if they can sort something out for you.

The CCJ will have been registered pre IVA and even though they never claimed it will not fall off until six years have elapsed. I am surprised it is showing as nil because the CCJ would have been registered for the full amount and any or no IVA payments would not have affected that.

Perhaps someone with a better understanding of how CCJs work could give a better answer.

Defaults -- there is ONE default per debt, dated on or around the start of the IVA. The monthly entries are not defaults, but merely reports basically saying "still in default". Your file will not clear up for 6 years after the start of the IVA, then all correctly dated defaults will drop off.
