Today someone drove into the back of my while driving to work.
Basically coming off a roundabout, a DXXK head in a black jag was trying overtake people before it goes into one lane.
I seen the idiot coming at the last minute as the road was quickly reducing to one lane, being in my 13year old seat, with a big jag flying at me, i panniced thinking i was about to be run off the road, I hit the brakes expecting him to pass through the gap. I guess the idiot realised he couldn't get through the tight space hitting his brakes as well resulting in him hitting the edge of my drivers side rear bumper.. He claims i deliberately braked and caused the accident, and has video evidance.
This happened this morning, and have been too busy at work to do anything about it. Looking at my insurance I have 13 years no claims, and my excess is £100 with Tesco Insurance. The only Damage to my car was the paint and trim on my bumper.
I don't have £100, and reluctantly i am willing to not claim becasue of this fact.
I feel if i don't tell my insurance, but claims i will be at blame because i didn't say anything.
I have been reading that i have to tell my insurance about it? but i could claim through the likes of winns (no win no fee)?
My wife had a minor car park ding, scuffing a taxi's wheel a couple of years back and told the insurance out of courtesy (not putting in a claim), only to receive a more than double renewal price, stating she had a at fault claim.
Anyone got any tips of advice? Obviously the likes of Winns are part of the 'The Credit Hire Organisation (CHO)'. What's the crack whilst on a IVA?
I know i need to tread carefully but quickly, in terms of the insurance company, but also carefully in relation to my IVA.
The accident should be reported to the company in case the other driver does that and it obviously wasn't your fault. Did you spot any video in his car? He could be scare mongering.
You could ask for a payment break to pay the excess so your car is back to normal.

If he hit you then he is likely at fault. Ring your insurance company and if necessary instruct a solicitor as you should be covered. Most solicitors offer free initial consultations and you would know better where you stand.
If he has provided his details let him know that you will be seeking legal advice and also may be visiting your doctor.
regardless of his argument that you braked 'on purpose' if he had left enough braking distance this would not have been a problem. My understanding is when someone hits you from behind they are almost always at fault, regardless.
been phoning a few people on The Credit Hire Organisation list, assuming there use would be acceptable during my IVA. However non seem to be interested. Suppose it's only a small claim to them so it's not worth the effort.
Told my insurance and they have given me the option if i want to claim? What? a recless driver hit me and i might not claim? I asked them for the best and worst case so i can think about it,
best:- i get my car fixed and pay nothing, NCD not affected.
Worst:- i am found (partialy/mainly?)responsible, have to pay the excess and increase premiums because of a fault claim.
If i dont claim, i dont have to pay the excess in any eventuality. But if the other driver claims my premium will increase due to a fault claim.
It kind of seems like if i dont claim mr jag who can afford the excess will win outright, because not claiming is a sign of guilt.
I am gambling with money i don't have (thank god its only £100 and not a £500 excess)
i dont think they ever alocat blame 100% either way even if you car is parked up and you not even in it.
I know i need to claim, it wasn't my fault, but living hand to mouth in situations like this is very daunting...
I got hit from behind and pushed into the car in front as a result. I claimed as it wrote of my car, as it was a no fault claim I didn't even have to pay excess this was all claimed from the truck behind me.
I would claim - the vast majority of accidents like this are the fault of the driver who hits you and don't forget that the insurance companies tell you never to admit liability even if it is 100% your fault.

The other driver is at fault, he can show as many driving clips from his dash cam as he wishes. The clips will also demonstrate his reckless disregard for the other road users he was bullying out the way. If he submits video 'evidence' demand that the video is at least 5 mins prior to the accident and not just seconds before he hit your vehicle. It is worrying but your account is credible and believable.
