Hello, I signed a promissory note alongside my husband to an investor of ours in 2007, we subsequently went into an iva with them being one of the creditors. We successfully completed the iva in 2014. This particular creditors solicitor is writing to us demanding payment. IS that possible?

Hi and welcome,

Not sure on this one but I would have thought that the debt was written off at the end.

Hopefully one of the experts will be along to advise further.

If the debt was included in the IVA it will have been written off at the conclusion. Further evidence of their inclusion would be if they received a dividend from the arrangement. Do you still have the paperwork ?

Send the solicitor a copy of the final report and tell them not to contact you again. If they have any queries direct them to your former IP but tell them that you will not be dealing with them.

No - as long as they were included/bound by the IVA that was the end of the matter.
