Am I in real trouble with my IVA ?

Hi
My husband and I are in a joint iva and we are just about to start our 3rd year. We have 2 cars which were excluded from the iva. We have over time changed both the cars as we wanted to get more economical cars/cars that met the needs of our family. My last car I have just had to sell as it started needing too many repairs etc. The money I had from the sale I gave to my dad and he lets me have the constant use of his car. As I wanted to let the iva people know I contacted them and they now want proof I sold the car and a letter from my dad saying that he received the money from me for the use of his car. I am having sleepless nights that I am in trouble with the iva company for not telling them I have changed the original cars they have on file. I've never made any money from the sale of them, just bought cars of the same value. So you think that I am in real trouble with my iva? I'm so desperately worried.

Hi and welcome,

Firstly you will have an interlocking IVA as there is no such thing as a joint one.

You can get your dad to provide a letter but I am also surprised that you were able to change your cars? Did you have to take credit for them?

No, we sold them and bought a new one for the same money. Never finance. Thanks.

You shouldn't have a problem then - just get a letter from your Dad and I am sure the company will be fine.

I don't see a problem either. The vehicles were excluded so in my opinion they were yours to do with as you wished. You need transport for work and have resolved this issue so no harm done.

As Michael says, if they were excluded your IP has no interest in the vehicles or their fate.

A**e covering exercise by you IVA company, they have a duty to know/report 'stuff' like this. They just want a trail so if a creditor gets snotty they can justify it. Don't fret it is just a paper trail.
