I'm waiting on a via creditors meeting on the 31st But I have payments due before that date. Should I pay them ?
I've been told not to. But I'm worried that if my Iva get rejected I'll be in a worse position

Any advice please

If you could afford to pay the creditors there would be no need for an IVA so I cannot see how you could pay creditors. If the IVA is rejected you could resubmit the proposal, enter a DMP or petition for bankruptcy. The one thing you could not do is go back to repaying creditors their contractual payments as otherwise you should never have proposed an IVA in the first place.

I hope this makes sense and I am sure you will be fine anyway.

Hi,

I never paid any of my creditors prior to the IVA and used some of the money to put aside as a contingency fund.

I am sure that you will be fine stu.

Likewise I stopped paying my creditors before the IVA meeting ... this gave me a modest emergency fund from the start.
My opinions are merely that .. opinions based on experience. Always seek professional advice.

Hi

We didn't pay anything for 6 months and once Stepchange had advised creditors of IVA none were a problem, and we had a lot more than you.
IVA completed with StepChange.
Last payment Sept 2016 CC Oct 2016

Hi stu1970,

As others have posted above, I stopped paying my creditors as soon as my IVA proposal was being drafted.

I wrote to all of my creditors informing them of my impending IVA instructing them to forward any future correspondence to my IP.

Most of my creditors left me alone but a couple of them still chased me for payment, I just ignored them and forwarded any letters to my IP.

Your IP wouldn`t have put your IVA proposal forward if they thought it could be rejected by your creditors.

It feels very daunting at the stage you are at, but things will be fine.

No you should stop paying now in readiness for the IVA.

Would it be ok to Cancel the Direct Debt for the personal loan ?

You can do but, they can always re-instate it as HSBC did with me even when I switched banks and cancelled it with the new bank.

Use this time to build a small contingency fund which you can then use in your iva - it will help you adjust to living on a budget

How can a direct debit be re-instate if it's cancelled?

Believe me - the creditors can, and will, reinstate it. They control the DD rather than a Standing Order which is under your control.

If the loan is paid from an account with the same bank it can be difficult to cancel. However if you have opened a new account with a different bank this should not affect you.
