Does car insurance excess paid back come under the windfall clause ?

Can someone help me please?
My car was hit by someone. The driver has admitted fault and we have received our car insurance excess back. I think we can keep it but my husband think it comes under the windfall clause. Can anyone shed any light on this?

How much are we talking about ?

Personally I think its yours to keep as this money was yours to start off with.

I would tent to agree -- this is money you paid over at the time of the repairs, out of your allowances, and you are just getting it back. If it is under £500 the chances are that, even as a windfall, it is still yours to keep.

You would have had to pay this out first anyway so it is only a reimbursement of your costs. I cannot see any IP treating this as a windfall.
