My mother in law has an iva. She has just been diagnosed with kidney failure and now needs constant dialysis. We are considering applying for attendance allowance for her. Will this be affected by the iva? Surely AA is for help with her health and not means tested. Any help appreciated.

It is not means tested BUT could be considered as income by the IVA company.

A lot will depend on how they deal with this and whether they offset expenditure.

From the point of view of issuing AA the IVA will not be a consideratn, but, as rdboxtree mentions, from the point of view of the I, any AA awarded will be considered income. However, most IP's will offset such an award with an equivalent expense so that it can be used for its intended purpose. Like many things IVA, it will depend upon who you are with and what view they take.
My opinions are merely that .. opinions based on experience. Always seek professional advice.
