Hi,
I'm looking for advice on my personal injury claim. I was injured at work 18 months ago. I wont bore you with the details and to cut a long story short, i am due £4000 for pain and suffering. I only started my IVA in february this year and wondered if i had to declare it to my Case officer?. Our house is in dire need of re decorating and several major appliances need replacing. Our 3 year old daughter also needs to move into her own bedroom. I have heard that you have to pay any windfall into your IVA, but is this classed as a windfall?. I cant seem to find anything in my IVA proposal to clarify the situation. I am with payplan, who my creditors recommended to me.

Any help and advice would be very much appreciated.

Hi and welcome.

I think it depends on what your claim is for but you do need to run it past your IP.

It may be classed as a windfall but your IP csn help you with this.

Hi and welcome to the forum from myself. I would do as Kallis suggests and run this by your IP as they will be able to give you a definitive answer x

Hi there,

Thanks for your quick response. I have e mailed my case officer. I think that is my IP?. I await her reply, but being a bank holiday i probably wont hear anything till tuesday at the earliest. I hope we get to keep at least some of it because we desperatly need some house maintenance. In regards to the accident, i had a plate of steel fall from a crane above. I was knocked unconcious and for several months i was vomiting with headaches and nausea. I only had sick pay for one week, so the majority,(if not all) of the claim was for the pain and suffering. I hope that you can retain some of the monies due to be received as you do deserve it after the accident. Fingers crossed here x

Thanks Lesley, Much appreciated. I hope so too cuz i think the mrs has spent most of it in her mind already!!. I told her not to keep her hopes up though because i have a bad feeling they will take it all!!...Like you say, Fingers crossed!!.

Thanks Foggy. I wouldn't have thought someone who presumably works for a PPI company would venture in here with all the posts about PPI at the moment!
