Hi I owned my house as joint tenancy with the person I cared for mortgage free.. he had taken out a IVA with Creditfix in 2017 which I did not know until he passed away in May 2020. I have found out that his debt was £16000 and now owes £21000 because of Creditfix charges.
Creditfix has now 6 weeks after his death applied to land Registry To apply a charge on my house I have not agreed to this with land Registry and waiting response.
The person I lived with was severely disabled and must have done this on his laptop but not of sound of mind to go through with this but Creditfix allowed him to.
I have lived at the house with my husband and 2 daughters one disabled and the Other person mentioned who tuck the IVA out for 10 years
Can anyone give me advice to where I stand
Resist the charge. The IVA ended on the persons passing ... any IP with any sense of morality would apply to creditors for a variation to make the IVA settled based on payments made to date, so done and dusted. CF however, might not --- they might not have thought about it, to be fair, but they already have 'form' for putting their own interests first.
My opinions are merely that .. opinions based on experience. Always seek professional advice.
