What will happen to my IVA if annual reviews haven’t been made by IP ( CreditFix) ?

Were you transferred to them and do you have a property to go into a 6th year?
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.

Hi ,


I’m 14 months away from finishing off my IVA I’ve only been asked to do 2 review maybe two so far and I’m at the end of my 4year with them. When I’ve changed my job I have called Creditfix to let them know of the slight salary increase but they have stated that there is no need for the phone call and the change in circumstances will be captured in my annual review . Since I’ve recently been transferred from Knightsbridge Insolvency Services to CreditFix I thought maybe CreditFix didn’t need to be informed about every little change and they will do it once per year. Now at the end of my 4th year they’ve done an annual review (the second one ever) and realised that in the last year I’ve earned 3 times more than in my previous years ( mostly overtime) and they expect me to pay 7k right away because that’s what I was supposed to throughout the last year and also I’ve breached the IVA agreement?

My question is haven’t they(CreditFix) breached the agreement first where they haven’t done an annual review every 12 months ? Also they’ve led me to believe that it isn’t necessary for me to let them know of any changes in circumstances?

I’m a little bit worried as I’ve not got the 7k right away or anytime soon as I’m expecting I’ll be losing my job in August.

Please can anyone help with any advice at all ?

I would write to CF directly to complain. By recorded delivery ( the old fashioned way) direct to the IP and keeping copies. This money will need to be paid, but CF can assist by extending the IVA with a sufficient period to cover the arrears. If no joy from this I would then escalate the complaint to their regulatory body, via the Government Gateway here: https://www.gov.uk/complain-about-insol ... actitioner

The regulatory body will not intervene directly but can impose quite startling fines and the threat of which may encourage CF to assist in sorting out this mess of their own making.

I was transferred to them yes , and I do not have a property. They have mentioned extending it for 24 months but how’s that gonna help when I’m about to either lose my job and / or overtime ? And I’ll be back on 25k per year if I manage to find myself another job . I’ll be forever in an IVA :)
