Hi, I am currently in IVA and for over 12 months now, and finding it hard but we are just about managing, my question is (if anybody can help) I maybe receiving a unexpexted windfall as my position at work has been regraded and I maybe receiving back pay plus a wage increase the back pay maybe about £4500 I know this has to go towards my IVA but we have had a broken gas boiler for the last six months with no hot water, the boiler man who came to repair said it needed replaceing and was not worth fixing we have tried to save for this but there always seems to be something else come up,would we be able to get the boiler replaced with some of this money? any advice from anybody would be great thanks

Assuming that you are only required to pay over 50% of the backpay - perhaps with a first 10% of your basic salary also being retained - wouldn't that be enough to meet the cost of the new boiler? If not, then I am sure that your IP would authorise the balance being taken out of creditors share - as a faulty boiler is a health hazard.

Hi Melanie, thanks for the reply but I am still a little confused, I thought that my back pay would be classed as a windfall not a bonus etc and would not be able to keep any of it, if I was allowed to keep 50% plus the 10% this would be enough for a replacement boiler, can you clarify this for me, thanks

It depends on who your IP is as well. I'm with Payplan and they didn't want any of my back pay at all.

Hope you do manage to keep most of it, especially as you really do need to replace your boiler.

It's not a windfall - definately ought to be treated as salary uplift so you should be able to keep at least 50%. But do check with your own IP.

Hi niallj

The first month after my IVA was accepted I received some backpay £1,500. My boiler was not very well and gas bills were very high. I spoke with my IP and they let me use most of the backpay to pay for a new boiler. I just had to send them a written estimate from the 'boilerman' and then send them the copy of the invoice.

I am with Payplan and we recently had backpay we were allowed to keep it as long as it showed as backpay on our wageslips.

IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.
