Aperture are sending out letters after Iva competition,with a questionaire for me to fill in.
It’s allowing a solicitor to delve into all aspects of my financial past, not just creditors in my Iva.
Do I have to sign or can I chase up any ppi myself,then hand over the refund if any.
Any PPI still belongs to the IVA, as recently confirmed by the courts. You are obliged to comply with all reasonable requests during the IVA, but exactly what your obligation to assist after the IVA is has not yet been tested.
To my mind it is money that I won't be getting so why bother to claim myself -- if they want the money let them do the work ! It isn't worth the ulcers worritting about something I am not going to get.
As for the principle of "can I do it myself" .... put yourself in Aperture's shoes .... would YOU be satisfied that YOU have done all you can to recover monies you are not getting ??

I am in the same position as you and having scrutinised the small print from FDM I am absolutely outraged and I can't even see what fees they charge. I will be making a complaint which I will follow through with the Ombudsman.
My advice is to do it yourself using template letters found on MSE or CAB websites and send them copies of all documentation sent and received. In the event their is a claim then at least 100% can be paid to the creditors.
Chances are that Aperture have already asked you on at least two previous occasions to comply with request from their appointed agents e.g. SHL before issuing closure. SHL's fees were at least 41% which is not in the interest of the creditors or you.
As for Foggy I suspect this person is not genuine and is either an IP or works for one.
Foggy is not an IP and neither does he work for one!!

If you are genuine then please offer constructive advice on how to deal with this.
So far it appears that the advice you have given is to simply sign an outrageous agreement allowing them to have full access to my finances and make any claim they want in my name and charge what fees they like.
He is genuine and does it really matter what the fees are? You won't have to pay them.

Malcolm ..... I can offer no more than I have already. I am not an IP or qualified in insolvency, so am unable to "advise" per se ... only share my thoughts, which I have done. You mentioned that you signed an agreement regarding PPI mid-IVA ... what did it say ... you are bound by that if Aperture want to push it. As I have said countless times -- what an IP can or might be willing to do to enforce such agreements, whether actual or implied, has not been tested. The only thing that has is that the PPI refunds belong to the IVA even after completion --- and I am minded to let them get on with it --- purely my opinion. You are free to pop an ulcer if you so wish.

The fees matter because that is money that should be paid to the creditors and for those in an IVA that will reduce the overall amount owed and perhaps reduce the term.
For those of us who have completed their IVA my understanding is that unless the debt has been repaid in full they can pursue and harass you forever with regards to mis-selling claims through companies like FDM.
As previously stated if memory serves SHL charged at least 41% and I have no idea what extortionate
fee FDM will deduct

The term would only be reduced if you managed to pay back the full original debt, plus fees and possible statutory interest .... very few ever get anywhere near that happening.
With regard to PPI they can only press you to make a claim until August of this year, when no further claims are to be considered.

I was contacted by this outfit first dispute ... now i completed my Iva 2 years ago got the certificate nothing on the register
aperture during my Iva instructed 2 different firms to sort the ppi out and i got no come back
this outfit called me a blagged that it was part of my Iva completion ..now im debt free carded up 999 experian etc
i asked the question why should waste my time filling out more forms as they through other firms they had instructed
i then asked heres the rub .... am i legally obliged to fill these forms in whats the benefit to me? ... answer they would pay me statutory interest on the ppi
i asked again my iva has completed 2 years ago i have a completion statement ,do i leagally have to fill the forms in? ... she said no!
thanks i said bye and put the phone down ....
gone away ...
august the 30th today i assume these ambulance chasers are out of work today....
Doubtful - there are all sorts of claims these days.

I am sure they will find something else to line their pockets. Current claims will keep them occupied for a good few months, then the double glazing firms will get their staff back. I am just thankful that the Gladstone Brooks chap can shut up now !
