Hello. I'm a substantially disabled, British Army Veteran on Military and Civilian Benefits. I am under an IVA, (3 year 5 months in at this time). I cannot work due to my disabilities. Payments relating to Military Service are; a War Disablement Pension, Ruined Clothing Allowance, Unemployability Supplement, Invalidity Allowance, War Pension Mobility Supplement, War Pension Constant Attendance Allowance, Comforts Allowance and a separate Army Service Pension. I also receive PIP for help with care and as I have been allowed to “retire” I am also in receipt of a small AVIVA staff pension.
My IP uses all these benefits and pensions to calculate how much i can repay and this repayment has risen every year since my divorce in 2016. I also receive full housing and council tax benefits.
My Question is - Is my IP right is using all my disability benefits and War and Service Pension allowances and supplements to calculate my IVA monthly payment? I am one month in arrears at present, they are aware and calculated a slightly higher monthly amount to cover this over the next few months.
Income is income, whatever the source. Often things like PIP are "cancelled out" by corresponding entries in expenditure for the items supposed to be covered by the PIP payment. The increases in your IVA payment should be limited to 50% of any increases in your income (plus any decreases in expenditure if you have made any for any reason).
