Hi
I have 2 questions:

1 - where can I find the CCCS guidelines?

2 - I have debt in my mum's name (used her credit card when I was out of work to live) I need to pay it off as she no longer has a job. How can this be added on my budget (IVA) as it is not in my name?

My understanding is you will not be able to add your debt that is in your mums name as it is her responsibility. You will need to agree a plan to action this after your iva concludes or through any savings from your allowances.

Your income and expenditure should be based on 'fact' rather than guidelines - be honest when writing it down and speak with your IP ...

The "Guidelines " are difficult to find as the companies / creditors do not want people using the figures there, but want you to use the actual figures you spend.

Your mums credit card cannot be included in your IVA, nor can the repayments be included in your allowances. However, your mum could be included as a creditor for the amount you owe her. But she would then only get the pence in the pound that everyone else gets. Also the debt could be set aside by the other creditors if the dividend is low.

You can't add the credit card as a creditor in your IVA but you can put your Mum down as a creditor.
