Me and my wife are in an interlocking IVA and 3 years in
We received a letter regarding child tax credits and due to overpayment they dramatically cut our payments
However they have now decided that there figures were incorrect and have payed us a lump sum of around £1800
We informed our Iva practitioner and sent them the letter we were told they were dealing with it but as yet still no decision has been made how do we stand

You need to push your IP for a decision on Monday so that you know what is happening.

If the earlier reduction in Tax Credits resulted in a reduction in your IVA payments, then the repayment could be due back to the IVA. If, however, you have soldiered on, with a reduced income stream, yet maintained the originally agreed payments, then I would argue that the refund is yours --- otherwise the creditors would be getting the benefit of this money twice !
