Hi.As you probably all know from my other posts, I am hoping to enter a full and final IVA in a few months time when my parents will have the funds to lend us. There is a lot of talk on another forum that I go on about people claimimg back unfair credit card charges. I know that OH and I must have hundreds if not thousands of pounds in credit card charges over the years between us and I am confident that I could claim some of it back. The query I have is would this affect my chances of success with having IVA accepted? I am not being greedy, I would be putting the money forward to add to the F and F IVA offer to hopefully increase the chances of it being accepted. Any thoughts? Thankyou x

It may pay to wait until your IVA is concluded, reason being is that any payout could be claimed as part of your IVA.

It won't affect your creditors' decisions on deciding whether to accept an IVA, but the door has been closed on a lot of these type of claims proceeding, so if you are going to claim, use a company that will do it on a "no-win/no fee" basis.

I would probably try to do it myself if I were going to. This other forum has template letters. Do you think I could wait until after the IVA is over but then I wouldn't be able to add to the F and F offer. Hmmmmmmm...maybe its just too complicated!!!

No - because once the IVA is over you no longer have those debts and therefore a reclaim is not applicable.

Thanks Melanie. I think it would have been a bit rude anyway lol...potentially have thousands of pounds of debt wiped out and then ask for more money back from previous charges...even I wouldn't be that cheeky!! Think I will leave well enough alone there.
