conflicting info on going bankrupt from IVA

Well update time

I contacted the OR to appeal the decision regarding the Car..

No movement,not a chance.

Car was taken away this morning @ 10:30am

I was quoted various Journeys that the OR's office had
calculated using www.traveline.info
Showing that I could get to work and back via Bus (Stagecoach)

I did my own checking and found the Information on this site to be
Inaccurate,which I then pointed out,but still no change.

I also showed that I would basically no longer be able to visit
one of my Friends via any Public Transport,basically,I would get there
just in time to turn around and go Home again.

So there it is Car has gone to the Auctioneers.

I am surprised about the car, however, I guess the OR must take on board many factors that differ from person to person, one being the level of debt and therefore the relative "need" to garner every penny.

This is purely a guess ... don't know if it applies to OR's but, in previous lives, I have been on the "official side" dealing with Agents acting on behalf of appellants and the reputation of the Agents, I am afraid, DID taint the way we regarded the whole case.

Thinking about it .. my brother went BR a few years ago and lost his car .. which was worth scrap value only! Mind you his glaring reason for getting into financial trouble was studidity on a grand scale (booze related) so I don't think he had much sympathy from the OR.

That is a ridiculous decision from the OR regarding your car. By the time they pay for someone to collect it and it is sold at auction I doubt they will be left with more than £500. Personally I would take this to Court and appeal if you have the belly for a fight - I predict that the Judge would tear a strip off the OR and you would probably get awarded costs as well.

Well,Car auctioned on the 23rd,and now already for sale on the 26th on Autotrader for £1895 by a smalltime Car Dealer.
I must admit I was surprised when The OR told me they were taking it.
Not sure about Appealing,I tried to explain the Circumstance once,but
they weren't interested.
So I think I'll just let it go for now.
Chalk it up to yet one more lesson from the University of Life.

I don't know what the mark up is these days -- but back along a mate of mine was in the trade and started with a minimum of a third. So the dealer probably paid less than a grand !

Yes.
I wouldn't be at all surprised if the hammer came down at £700/£750.
Trade in was about £1300,last I looked,and when it went to Auction the Exhaust was blowing and the ECU fault was lit,plus I accidentally forgot to put the Service History in the Glovebox oopps!!,so all in all The OR got peanuts.

You were well restrained Misters ---- I might have been tempted to add a few scratches and a cracked windscreen .... mind you, with my luck, after doing that the OR would have changed his mind and let me keep it !!!!

Well,a workmate suggested I put Diesel in the Tank,but I just removed the Service History and the Optional extras that were fitted.
So I might make a bit of money from that :)
