I am a year into my IVA and I believe I have been missold it. The majority of the debt was to CSA, I have recently recieved a letter from CSA to say that the money i owe them cannot be included in any bankrupsy or IVA and that the arrears have been suspended until I can afford payment. If I didn't have this CSA arrears I would not qualify for the amount to get an IVA in the first place. Please advise me on what to do!!

Hi,

Unfortunately CSA arrears cannot be included in an IVA.

Which company are you with?

Speak to your IP rather than one of the caseworkers and find out what went wrong. It is important you do this sooner rather than later so you can move forward to a more suitable debt management solution (possibly with a new company). I would also check with your IP what your position regarding fees paid would be if you switched to another firm at this stage.

I am with Freeman Jones, I have tried to speak with them about it several times but they keep fobbing me off saying not to worry and they will sort it out with CSA

You should have been told about the CSA at the time you started your IVA. CSA payments are one of the few debts not included.

It is very difficult to switch to a new IVA company once in an IVA an it would cost an awful lot of money to do so.

CSA Cant be included in an IVA, were they listed in your original proposal as an unsecured creditor and not a preferential creditor which you were to continue to make payments to ?

Was there an allowance perhaps in your income and expediture to maintain this debt.

My partner has CSA arrears also and although we couldnt count them in with the debt, we have been allowed to include the payment to the CSA on our expenditure so we are no worse off.
Hope this makes sense.

CSA payments will be included as expenditure in an IVA, and any arrears can't be included as a debt in the IVA.

Other than my CSA debt, I was in debt of £6k, Without this CSA arrears I would have not been able to get an IVA. No wonder CSA didn't turn up to my creditors meeting at the beginning. I have spoken with CSA about this and they have suspended any arrears for the time being, but obviously I am paying the money to Freeman Jones for the CSA as it is included as a debt in my IVA. I have spoken to Freeman Jones about this on several occasions and they say that it can be included and they will sort it with CSA!! This was 3 months ago now and I have left several messages for them to call me and explain what is going on and they have not replied. I called CSA and asked if they had spoken to the company and they told me that no-one had called them. Obviously I am quite worried now, I'm paying for the debt but it isn't getting sorted with CSA. Does anyone know of a company that deals with missold IVA's? Please help, before I pay for another 4 years and still have this CSA debt

Have you contacted your IP directly? You can get their name and email address from www.insolvency.gov.uk/fip.

If you aren't satisfied after speaking to your IP, the site I mentioned also has a section on how to complain.

I am surprised that your company allowed you to include them.

You can make a complaint about your IP company but in the first instance it should be done via their inhouse complaints procedure as far as I am aware.
