morning all , my sister is looking into a debt relief order and reading about it she has to go through an approved third party, she contacted a company called Spencer Hayes does any one know of them ?, also will she have to pay a fee to the third party like you do when in an IVA or DMP, she knows that the initial cost is £90 for the paperwork to be done , i have looked up the compny she has been in touch with and its not one that i have heard of even on this site, i understand that to be an "approved party" you need to be specially credited but can find nothing on them to say they are,. Are there any of the companies that you all deal with on here an approved company that may be able to help her.

Spencer Hayes are not an approved body and you do not need to pay a fee to them for sorting out a DRO. This new procedure was specifically designed for people with low debts who could not afford even the Court costs of bankruptcy, let alone any unecessary professional fees.

I suggest that you contact CCCS, Payplan or the CAB and use the one who can give you the earliest appointment.

hi all and thanks for your replies , helen she has not been told anything yet as she was just in the inital stages of finding out about it the company just sent her some paperwork to write her I/E down, i have suggested to her to go to CAB as she does not have a computer , she phones me and i try and search things for her , thanks for all your help

Baines and Ernst is another one, as is Institution of Money Advisers, National Debtline, Shelter, Insolvency Practitioners Association and Advice UK.

I have no idea if any fees would be payable to these, but I doubt it.

DEBT RELIEF ORDERs: COMPETENT AUTHORITIES

Debt Relief Orders (DRO) are come into force on 6th April 2009. In contrast to other forms of debt relief, DROs are delivered in partnership with debt advisors, primarily from the advice sector. Representatives from the advice sector act as ‘approved intermediaries’ and assist debtors in making their application for a DRO to The Insolvency Service via an online application form. For an advisor to become an approved intermediary they must apply to a ‘competent authority’ to act as such.

A competent authority is a body designated by the Secretary of State as being able to authorise intermediaries. It is the competent authority who will then decide whether to grant an individual the authorisation to act as an intermediary, and not the Insolvency Service. As such, if you would like to apply to become an approved intermediary please do not contact the Insolvency Service.

The competent authority is responsible for ensuring that intermediaries have the appropriate training and experience, as well as to ensure that the appropriate complaints and equal opportunities procedures are in place. An organisation can become a competent authority by application to the Secretary of State.

In advance of DROs coming into force the Secretary of State has given the interim approval to six organisations to act as Competent Authorities. To apply to be an ‘approved intermediary’, please contact one of the following authorising bodies:

They are a competant authority who are able to direct consumers to an approved intermediary.

I am not sure that they are an approved intermediary - or would have the resource to be able to process actual applications, but I could be wrong. The last three on the list are competant authorities, but I believe the first six named are the only approved entities who can actually assist with the obtaining of a DRO.

Confusing or what???

thanks all for the advice mind you i think im still confused with all the jargon . anyway i have given her the number of payplan and she is going to ring them on monday and find out more so fingers crossed for her

I hope your sister gets on ok with Payplan on Monday, have to admit to knowing very little about a DRO x
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Hi Missfit,

There is a £90 fee for a DRO application, this fee money goes to the Insolvency Service. I have attached a link to the Insolvency Service website so you can have a read up about DROs and the second link is a list of Competent Authorities.
