Debt with charging order

I started an iva in 2006 with a company called debt matters. They then transfered it to Grant Thornton. This was the worst 7 years of my life. Finally after paying back almost every penny i owed and they claimed my ppi back and I got zero from these, I finished my iva March 2014. I got my cert. And have since had a good credit rating and got manageable loans etc. Now I have received a letter from a solicitor about a debt I owed to alliance and leicester. They have put a charging order on my property. This debt was included in my IVA. I have proof and I have sent it to them but they say I still have to pay?!?!?! Any advice would be grateful. Karl

They are wrong ! However, you should seek legal advice from a solicitor experienced in debt matters to fight your corner --- CAB might be able to assist.

Thanks for reply. They have probably ruined my credit score and if I sell my property they get £3000! I cant contact Grant Thorntons as they cant locate the person who dealt with me. Is Grant Thornton still at waters edge in belfast? There numbers dont exist. What a sham. I would strongly advice any NEVER to take an IVA out!

Hi, definitely do what Foggy says and take advice.

As a matter of interest now that you have the benefit of hindsight, what do you think you should have done to deal with your debts? What would you do if you had that time again?

Interested to know what you think.

I would use a debt management charity. I paid back almost every penny. Also I got a ccj against me whilst in the IVA and I paid it. Later realizing it was included in the IVA. After 5 years of paying. They made me pay another year because I had a small amount of equity in my home. The creditors get little back and the rest makes someone very rich!

Grant Thornton's IVA section morphed into Aperture -- and many of the staff went with it. What was your IP's name?

Think it was Amy Saunders. Not got paperwork with me at moment but there are some other names. Seem to have been passed from pillar to post with them.

Mark Allen is no longer registered as an IP with the Insolvency Service. Aperture now operate from Water's Edge in Belfast.

Was the debt listed on your closure report? Did they receive dividends?

When was the charging order applied - was it before your IVA started or after? If it was before, the debt wouldn't have been bound by the IVA. If it was after, you might be able to get Aperture to fight back for you. Send an email to ivatrusts@aperture.uk.com with as much info as you can remember, and hopefully they'll be able to do something for you.

Thanks. I will start with a call to them. Think the order was made recently. My concern is how many others could follow. Was my IVA a scam
