Despite having statement saying ISP had no interest in PPI, now say they have.

I completed a full and final IVA in 2007 and have the completion certificate . I recently started ppi claims this year relating to creditors within the IVA through a CMC . The CMC inititially secured a statement of no interest in pursuing PPI from the ISP , and have succeeded in obtain some refunds . However one creditor has sent the payment directly to the ISP ,who has now decided they have an interest in the ppi . I have a copy of the initial statement of no interest do they have a right to do this as this having previously stated no interest .

In law they do have a claim -- I do not know how a statement of no interest would hold up in court, if it went that far. However, at the very least I would expect them to pay the Claims company fee, as you proceeded to engage the company on the basis of their statement.
Really depends on how far you want to take this .. but, initially, try to get them to honour their initial statement.
