My husband has taken an IVA out and unknown to me they have put a restriction on the property.
The IVA has not been getting paid and me and my husband have been separated for 12 month and he won't speak to me about the amount that's owed.
Within the last 7 days I have received a letter stating the IVA has not been paid and they want to sell the property.
It is an individual IVA but with restriction on property they said because of data protection they can't speak to me.
If we sell the house does it mean they can take what little equity I have on the property or just my husbands half also how can I find out the amount owed to get this sorted out.

The IVA Supervisor does not have the power or capacity to sell the property.

Only you and your Ex husband can do that.

Who has written to you please - this is important?

Are you sure he's not been made Bankrupt and it's his Trustee in Bankruptcy writing to you?

If so that will complicate things as the Trustee will have the power to repossess and sell the property if they have a material interest in it and cannot reach an agreement with you to buy their interest off them.

This might be your opportunity to buy your husband out. How much equity is in the property and can you afford to make an offer?
